Need Help...Legal advise

my father worked for 7-eleven for nearly 3 years...then he took vacation, when he came back from Vacation..the day he was back...he was told take 4500.00 + sign the relees form...they told him since we giving you a sevrance pay...we don't have to give you reason...and nice working with you..
as my father refuse to sign the relees form..he left the office and said I see you in court...
he has until tomorow to get back to them...
any advices?

FYI: he was never written up for any reason...

He MUST have a legal representative otherwise things may not go well. There are so much complexities in the law that we are not aware and a lawyer would know; advice from ordinary people may not be in your best interest. Usuall, in Australia, if a man is unemployed he can get a free lawyer. Also, even if u r not unemployed, IF u have a lawyer and u win u will get the legal costs back on top of your win.
Alternatively, check the Internet for the relevant laws. Whatever u do, don't go there unprepared, without knowing the exact laws and don't expect the judge to defend you (otherwise the lawyer of the 7/11 would sue the judge). Can u see the dilemma? The judge is there to 'hear' from both sides NOT to take someone's side.
I hope your dad gets all his entitlements from the bastards

That's good advice IMHO. As far as I know, they're not even required to pay "severance pay" if he has been working there less than 5 years. And the minimum termination pay is roughly one week for each year of employment. If they are offering your dad "severance pay", it does not mean that he is being fired or needs to be written up first. He is simply being "dismissed" or laid-off, neither of which require the type of record keeping that being "fired" does. Going to court over such cases is often more costly and does not always yield good results.

as bahonar put it correctly, he is lucky they are paying him
some .however if he goes to labor after some headache they will tell him that, is employer right to do that .i don't konw on what bases he wants to press charges .however canada is more socialist than this state though .
these are his options
1-age discrimination
2- race discrimination
3- defamation of charactor ( called him terrorist or something during the work,needs a good witness though ).that is about it
